Terms and Conditions for Donations to Maa Pushpa Seva Sansthan Trust
1. Introduction
These Terms and Conditions ("Terms") govern all donations made to Maa Pushpa Seva Sansthan Trust ("the Trust"), a registered non-profit organization. By making a donation, the donor agrees to be bound by these Terms.
2. Donation Process
2.1. Donations can be made through the Trust’s authorized payment channels, including but not limited to bank transfers, online payment gateways, or other methods specified by the Trust.
2.2. All donations are voluntary and non-refundable unless explicitly stated otherwise by the Trust.
2.3. The Trust reserves the right to decline or return any donation at its sole discretion if it suspects any irregularity or non-compliance with these Terms.
3. Donor Consent and Responsibility
3.1. By making a donation, the donor declares and warrants that:
a. The funds donated are from legitimate, lawful sources and are not derived from any illegal activities, including but not limited to cybercrime, fraud, money laundering, or any other unlawful activity.
b. The account or payment method used for the donation is owned by the donor or the donor is legally authorized to use it.
c. The donor has conducted due diligence to ensure the accuracy and legitimacy of the payment details provided.
3.2. The donor acknowledges and agrees that they shall bear sole responsibility for any issues arising from the donation, including but not limited to disputes, chargebacks, or investigations related to the source of funds or the payment method.
3.3. The Trust shall not be held liable for any legal, financial, or other consequences arising from the donor’s failure to comply with applicable laws or these Terms.
4. Indemnity
The donor agrees to indemnify and hold harmless Maa Pushpa Seva Sansthan Trust, its trustees, employees, and affiliates from any claims, liabilities, losses, or damages arising out of or in connection with the donation, including but not limited to any fraudulent or illegal activity associated with the donated funds or payment method.
5. Use of Donations
5.1. The Trust will utilize the donated funds in accordance with its charitable objectives and mission, as determined at its sole discretion.
5.2. The donor acknowledges that they have no right to dictate or control the specific use of the donated funds unless otherwise agreed in writing by the Trust.
6. Data Protection
6.1. The Trust may collect and process personal information provided by the donor (e.g., name, contact details, payment information) in accordance with applicable data protection laws and its Privacy Policy.
6.2. The donor consents to the collection and use of their personal information for the purpose of processing the donation and related communications.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Deoghar, Jharkhand, India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Deoghar, Jharkhand, India.
8. Amendments
The Trust reserves the right to modify these Terms at any time. Updated Terms will be posted on the Trust’s official website or communicated to donors as deemed appropriate by the Trust.
9. Donor Acknowledgment and Consent
By making a donation to Maa Pushpa Seva Sansthan Trust, I, the undersigned donor, confirm that:
- The funds I am donating are from legitimate and lawful sources.
- The account or payment method used for this donation is legally owned or authorized by me.
- I am solely responsible for any legal, financial, or other issues arising from this donation, including any involvement in cybercrime, fraud, or other unlawful activities.
- I agree to indemnify and hold harmless Maa Pushpa Seva Sansthan Trust from any claims or liabilities related to this donation.
- I have read, understood, and agree to be bound by these Terms and Conditions.
Donor Consent:
By proceeding with the donation, I confirm my acceptance of these Terms and Conditions and take full responsibility for the legitimacy of the funds and payment method used.
माँ पुष्पा सेवा संस्थान ट्रस्ट को दान के लिए नियम और शर्तें
1. परिचय
ये नियम और शर्तें ("शर्तें") माँ पुष्पा सेवा संस्थान ट्रस्ट ("ट्रस्ट"), एक पंजीकृत गैर-लाभकारी संगठन को किए गए सभी दान को नियंत्रित करती हैं। दान करके, दाता इन शर्तों से बंधे होने के लिए सहमत होता है।
2. दान प्रक्रिया
2.1. दान ट्रस्ट के अधिकृत भुगतान चैनलों के माध्यम से किए जा सकते हैं, जिनमें बैंक हस्तांतरण, ऑनलाइन भुगतान गेटवे, या ट्रस्ट द्वारा निर्दिष्ट अन्य तरीके शामिल हैं, लेकिन इन्हीं तक सीमित नहीं हैं।
2.2. सभी दान स्वैच्छिक और गैर-वापसी योग्य हैं जब तक कि ट्रस्ट द्वारा स्पष्ट रूप से अन्यथा न कहा गया हो।
2.3. ट्रस्ट किसी भी अनियमितता या इन शर्तों का पालन न करने का संदेह होने पर अपने एकमात्र विवेक पर किसी भी दान को अस्वीकार करने या वापस करने का अधिकार सुरक्षित रखता है।
3. दाता सहमति और जिम्मेदारी
3.1. दान करके, दाता घोषणा करता है और वारंटी देता है कि:
a. दान की गई धनराशि वैध, कानूनी स्रोतों से है और किसी भी अवैध गतिविधियों से प्राप्त नहीं हुई है, जिनमें साइबर अपराध, धोखाधड़ी, मनी लॉन्ड्रिंग, या कोई अन्य गैरकानूनी गतिविधि शामिल है, लेकिन इन्हीं तक सीमित नहीं है।
b. दान के लिए उपयोग किया जाने वाला खाता या भुगतान विधि दाता के स्वामित्व में है या दाता इसे कानूनी रूप से उपयोग करने के लिए अधिकृत है।
c. दाता ने प्रदान किए गए भुगतान विवरणों की सटीकता और वैधता सुनिश्चित करने के लिए उचित परिश्रम किया है।
3.2. दाता स्वीकार करता है और सहमत होता है कि वे दान से उत्पन्न होने वाले किसी भी मुद्दे के लिए एकमात्र जिम्मेदारी वहन करेंगे, जिसमें विवाद, चार्जबैक, या धन के स्रोत या भुगतान विधि से संबंधित जांच शामिल है, लेकिन इन्हीं तक सीमित नहीं है।
3.3. ट्रस्ट लागू कानूनों या इन शर्तों का पालन करने में दाता की विफलता से उत्पन्न होने वाले किसी भी कानूनी, वित्तीय, या अन्य परिणामों के लिए उत्तरदायी नहीं होगा।
4. क्षतिपूर्ति
दाता माँ पुष्पा सेवा संस्थान ट्रस्ट, उसके ट्रस्टियों, कर्मचारियों और सहयोगियों को दान से उत्पन्न या उसके संबंध में किसी भी दावे, देनदारियों, हानियों, या क्षतियों से क्षतिपूर्ति और हानिरहित रखने के लिए सहमत है, जिसमें दान किए गए धन या भुगतान विधि से जुड़ी कोई भी धोखाधड़ी या अवैध गतिविधि शामिल है, लेकिन इन्हीं तक सीमित नहीं है।
5. दान का उपयोग
5.1. ट्रस्ट दान की गई धनराशि का उपयोग अपने धर्मार्थ उद्देश्यों और मिशन के अनुसार करेगा, जैसा कि उसके एकमात्र विवेक पर निर्धारित किया गया है।
5.2. दाता स्वीकार करता है कि उन्हें दान की गई धनराशि के विशिष्ट उपयोग को निर्देशित या नियंत्रित करने का कोई अधिकार नहीं है जब तक कि ट्रस्ट द्वारा लिखित रूप में अन्यथा सहमति न हो।
6. डेटा संरक्षण
6.1. ट्रस्ट लागू डेटा संरक्षण कानूनों और अपनी गोपनीयता नीति के अनुसार दाता द्वारा प्रदान की गई व्यक्तिगत जानकारी (जैसे नाम, संपर्क विवरण, भुगतान जानकारी) एकत्र और संसाधित कर सकता है।
6.2. दाता दान और संबंधित संचार को संसाधित करने के उद्देश्य से अपनी व्यक्तिगत जानकारी के संग्रह और उपयोग के लिए सहमति देता है।
7. शासी कानून
ये शर्तें देवघर, झारखंड, भारत के कानूनों द्वारा शासित और समझी जाएंगी। इन शर्तों से उत्पन्न होने वाले किसी भी विवाद को देवघर, झारखंड, भारत में न्यायालयों के विशेष क्षेत्राधिकार के अधीन किया जाएगा।
8. संशोधन
ट्रस्ट किसी भी समय इन शर्तों को संशोधित करने का अधिकार सुरक्षित रखता है। अद्यतन शर्तें ट्रस्ट की आधिकारिक वेबसाइट पर पोस्ट की जाएंगी या ट्रस्ट द्वारा उपयुक्त समझे जाने पर दाताओं को सूचित की जाएंगी।
9. दाता पावती और सहमति
माँ पुष्पा सेवा संस्थान ट्रस्ट को दान करके, मैं, अधोहस्ताक्षरी दाता, पुष्टि करता हूं कि:
- मैं जो धन दान कर रहा हूं वह वैध और कानूनी स्रोतों से है।
- इस दान के लिए उपयोग किया जाने वाला खाता या भुगतान विधि कानूनी रूप से मेरे स्वामित्व में है या मेरे द्वारा अधिकृत है।
- मैं इस दान से उत्पन्न होने वाले किसी भी कानूनी, वित्तीय, या अन्य मुद्दों के लिए पूरी तरह से जिम्मेदार हूं, जिसमें साइबर अपराध, धोखाधड़ी, या अन्य गैरकानूनी गतिविधियों में कोई भी भागीदारी शामिल है।
- मैं इस दान से संबंधित किसी भी दावे या देनदारियों से माँ पुष्पा सेवा संस्थान ट्रस्ट को क्षतिपूर्ति और हानिरहित रखने के लिए सहमत हूं।
- मैंने इन नियमों और शर्तों को पढ़ा, समझा और उनसे बंधे होने के लिए सहमत हूं।
दाता सहमति:
दान के साथ आगे बढ़कर, मैं इन नियमों और शर्तों की अपनी स्वीकृति की पुष्टि करता हूं और उपयोग किए गए धन और भुगतान विधि की वैधता के लिए पूरी जिम्मेदारी लेता हूं।
